gutted mate

Was the bin empty and had ti been left by your car by the binmen

Was it your bin..

If it was empty and left out by bimen, send a claim to the council. Worth a try

If it wasnt your bin, they try n claim from who ever it belonged too

all bins belong to the council,  if they put it there, then blame them. it was clearly not secure.

Think it's well harsh to try and get the council to foot the bill. The title of your thread does say "Look what the wind did" and not "Look what a careless council employee and his badly placed wheely bin did".

It's an accident for god's sake…

Sorry to see that damage. I wouldn't expect the council to pay out for it either…short of tying each bin to each property's door handle/gate/fence, there's not a lot the binmen can do about wind.  :(

i hear ya' there, but at the same time…..i take my dog for a walk every morn. and every wednesday morn i take the dog to the field with no problems at all, theres a nice tidy line of bins down one side of the pavement, usually grouped together. on my return the bins have been emptied. and i find myself dodging bins likke they are out to get me or something. is it that hard to place a bin back were you get  it from, instead of just bowling it into the pavement and hoping it doesn't fall over. i'm not even exagerating when i tell you that i have to move at least 2 bins before me or my3 neighbours can leave our part of the street. it's fine when we leave the bins,
why can't they just pop them back from where they were taken
if any damage is done from there then fairplay, i put it there to start with, my fault.
but if they just bowl it onto my part of the road and it sits in the dip next to our car its 90% more likly to get blown over by the wind.

forgive me for thinking that if the council want us you use these bins they should make them user friendly by having a place to put them where they will not be a niusence to anybody in anyway. this includes "windy days" safe.

RANT OVER!

It might depend on where the car was parked to whether the council can be held liable, if you had it on your own private drive i'd say you stood a chance. On a public highway it could be tough, you'd need to prove the bin men were at fault. Does the council hold an insurance policy for damage and accidents surrounding general council maintenance?

Besides that how can you prove that it was the bin that did the damage.
They are clever at the council & will ask you for proof….
I doubt they will even entertain your claim….

Well in my defense i haven't asked the council for compensation just what to do in this situation and if there are any specific procedures to stop it happening again. I am informing the council not asking for anything i really don't think its their fault but then again i have to foot the bill for something that is not my fault. I was parked legally and well away from any bins for this exact reason!!!

Chris,

*sorry to go off topic.* Remember reading you have some 6x9s in the footwell (?) wondered if you could put some pics up/PM me them to see how you've done it. That would be ace.

And to reply to the above, the council wouldnt pay out for toffee.

Cheers, Charlie
