Legally speaking, insurance isn't invalidated by no MoT - but it would be taken into account if/when they assess the value of her car. (No licence, does invalidate it).

Main thing is you're alright(ish) - shame about the Mk2 but then it won't be missed, unlike if it were a Mk1 involved. The good thing is, because you'd so recently bought it, they will have no opportunity to downplay its value - you should (eventually) get the whole price you paid for it, stright back.

Not strictly true, many insurance policies now state that you must have a valid MOT.

Therefore invalidating your insurance.

Trade plates are nothing to do with MoT, more to do with (lack of) tax. Having an MoT doesn't make a car roadworthy, in the same way not having one doesn't make it unroadworthy!

I've just checked my insurance and I am covered if my car is unroadworthy or has no MoT.

Glad you're ok. Likely she had no MOT because she knew it wouldn't pass. Could've been a lot worse.

Please take this irresponsible driver to the cleaners. Hearing about all these people that drive without insurance or mot's p's me off. Makes me wonder why we should go through the pain of insurance and indeed getting our car through the MOT  :banghead: if micky takers get away with it :evil:

Thanks for ALL the kind words, im still gutted about it, not just because of the car but the fact  that i've got to mess about sorting everything out!!!

The girl didnt seem to be very sypathetic, she said "well its only a cheap car at the end of the day..!" errrr yes it was cheap but i could of had the car years, been in the family or meant a very lot to me!!!…whats that got to do with anything??

She did tell me that her mot ran out quite a while ago…im not talking a week or two here…cant remember when she acutaly did say but im sure it was like a month or somthing….which followed by "i was gonna run around till the tax ran out then take it to the scrappy and get a cheap metro for 200 quid"  :banghead:  :roll:

I was only TPFT, im not sure what that involves but i certainly dont get a curtessy car which means its gonna be diffecult getting to work etc, i also had to pay out of my OWN pocket to have the car recoverd home and dumped on my drive…

Been down to the docters today and hes gave me a sick note and told me to rest for a week, he also wrote a report out stating whats wrong with my arm incase i get a claime in.

i havnt got in touch with the police yet tho, am i too late? i got told by my insurance that they will deal with that???

No its not to late to get onto the cops.

In that case, throw the book at the dozy bint!

Watch out though, cause if she can prove in some way that she was en-route to a garage to A: have something done to the car, to make it road legal or B: going to a garage to HAVE an MOT done or C: coming home from a MOT failure, she has every right to be driving on the road, regardless of having an MOT or not

well where she was heading is a dead end…she told me she was only popping to her friends house…

The thing is, the addrese that she gave me is on the other side of town, she must be very brave or just not give a sh1t to come all that way, through a city center just to see her friend… :dontknow:

throw the b……..y book at her, it costs us all loads to run a legal car, why should she get away with it

the fact that she was miles away from her home proves that she wasnt going to or coming from an mot.

maybe next time she wont drive around in a maybe dangerous un roadworthy motor!

Make sure you tell them that she asked you not to go through the insurance for the very reason that she had no MOT. The fact that you even know proves that she told you herself, or how would you?

Alright Karl, sorry to hear about the bump. Glad you're ok though.

In law you have had an 'injury accident' and as such the matter should be reported to the police within 24 hours unless they attended at the time. I didn't see any mention of them turning up at the bump so I take it that they didn't otherwise a HORT/1 would have been issued for drivers to produce their documents… Licence, MOT and insurance within 7 days at a nominated police station.

If I were you, I'd pop along to Bamber Bridge, report the matter and they will get an officer to call round to the other drivers' house to see her docs. This will all take time as the paperwork will go to a 'proccessing' department.. it will take even longer if its outside the county. (Is it the Mersey tunnel?)

You mention that your brakes were bad, just how bad were they? I'd hate to refer you to the cops only for them to inspect YOUR car and prosecute you for dangerous condition!!!

At the end of the day the other driver could be reported for careless driving at the least.

Get well soon pal. Let us know what happens or better still come up to one of the meets.

Are you sure its one way? I'd be very careful about your statment on this one. If my placement is correct I believe the scenario to be 50:50 (if you both entered the tunnel at the same time…) or the first car in the tunnel has right of way. Not saying you were but it could come out you were driving too fast and it was your driving neglegence. You would be on the best footing if you state you were the first car in the tunnel, driving slowly… and she zoomed in and hit you, (giving you no time to brake, react, manoeuvre) if that is the correct scenario. Of course I'm not suggesting you twist the truth.

It's definately worth putting in for a whiplash claim (again if this is correct). I used "Accident Repair Centre" at Preston…. they handled it all, the insurance claim, whiplash claim and provided me with a courtesy car while they sorted it all out. Recommended :wink:

Glad you're ok dude. Don't worry about letting me down on buying the head I understand. I'll shove it on ebay. (Anyone want a brand spanking new never fitted,ported & pollished, biggest valve possible, competition cylinder head for a 1.8 gti? )

I used to own a mk1 - well I've had 2 actually - YDU 720X & SMU 420Y. Currently I drive an 98 Scotia White Mitsubishi Evolution V RS…. fancy getting another mk1 someday :D
