My ex did me big style, but I was married, she got 75% of the house proceeds as we got 2 kids. The judge did not even take into account the fact that she lied in her papers to the Court, plus the fact that she emptied all the bank accounts, inc the Childrens money, plus was getting into my wages and did not pay the bills despite recieving the money to do so, then took her name of the bills and transferred them into my name solely. She syphoned my wages secretly, but as I could not show what she did with the money (secret bank account, as there was deffinately nothing showing in our house to justify the ?400.00 a week she was spending). The main thing is your Child. If you get Solicitors involved be expected for all sorts of nasties, allegations, counter allegations, if she gets upset, you will not see your child, As for the judicial system it wil take a Judge with real conviction to rayne her in. In reality the Family courts are overworked, not enough time slots, full of un proffessional people who only care about the money. Remember Barriters are adverserial and that is no place for them to be with tensions allready running high. As for the judges I have not come across one yet that will imprison a reticent Mother. As they misuse the Childrens act, not in the best interests of the Children to Jail mother for breaching a Court Order.
Most cases are heard by a district judge, who will do diffrerent aspects of law, not full time Family Law. If you can get her to sign away her share of the house cheaply it's worth it. As for legal aid you WILL have to pay that back, they can put a charge over your property and charge you 8% per annum until it is discharged.
Always remember the law is an ass and there is no justice in law either.
I represented myself in Court as a Litigant In Person for 4 years (5 years in total as I ran out of money) and it got me no where. (they don't like it).
Sorry if I ranted but just expect the worse and if it all comes good then, thats a bonus. Good luck Fella. Please remember we all have different circumstances, I would say mine was at the extreme end of the spectrum.

Been to see solicitor today, she reckons I have a good case for getting the house signed over free/cheap - but then she would say that wouldnt she!! She is drafting a letter to send to the ex, so will find out in a few days where she gets to.
So what we saying then - marketon pub? what day suits best?

Some friendly advise, just be careful with the mortgage side of it too. I brought my ex out last year and with the pay out and taking on her half the mortgage it went over the stamp duty level and that was 1% again on a house i aleady owned and had paid stamp duty on 4 years before seems criminal i know, there are ways to massage figures ) so keep it amicable between you and the ex you never know if you need her to say something like the mortgage split is 80:20 in your favour to get below stamp duty levels etc.Just take for instance a 300k mortgage on your house split 50;50 even giving her nothing means in effect in the eyes of the land registry you are giving your ex ?150k meaning you could end up paying ?1500 to HMRC but split 80:20 would mean in effect you are only taking on 60k and below duty levels. Believe me i know first hand.

she only got left in the car coz of the dog,i am not that cruel all the time,but i bet she says different!!!she dont finish untill 2 so sometime after that,unless i can scrounge a lift???loubylou 71 said
