advice needed....lost deposit ...
i spoke to the owner and we agreed a price , and he did agree to hold onto the car for a while to give me chance to raise the cash ……
all was going well i had sold enough to raise the agreed amount , i sent payment of £500 3 days before i was due to collect the car with the rest to be paid on collection anyway sme of the cash was paid into my account which was swallowed up by my overdraft ….the bank then decided that my overdraft was a tempary thing and reduced the allowance on my overdraft …which then left me short of cash to buy the car , and so i had to pull out of the sale ……. the seller then sold the car that same weekend and is not willing to return my £500 ……is there anything legally i can do ?????
really annoyed about losing £500 , but even more annoyed at selling everything i can and missing out on buying my old car back ….

Apparently bank transfers are done at the senders own risk and is the same as handing over cash.
Now she didn't do that sort of stuff when she worked in the bank but she's pretty sure there's nothing that can be done.

You wouldnt be able to do anything with just a sort code and acount number.

problemis a deposit is normally non refundable so it would be good gesture on hispart tbf

A similar thing kind of thing happened to me through Ebay and in the end I did it through the Police, they were great and got in touch with the dodgy seller - the goods came to me the very next day

Also if it gets to police/solictors, was the £500 a 'holding' deposit or the 1st payment? If a holding deposit and then you couldn't meet the final agreed time/payment he could claim you failed to meet your side of the agreement/contract. You paid for him to hold it and he did so he keeps the £500. If it was the 1st payment, you have paid for something you haven't received and so need your £ back.
I think its a pretty bad show on his part. You obviously showed good will and stumpted up a big deposit/1st payment showing you intended to buy it, however other problems stopped you so he sold it and presumably got his asking price? If you had back out and he still had the car he would have grounds to feel a bit hacked off esp if he'd turned away other propective buyers. But he didn't. Looks to me like hes got is cake and eating it.

you have a right to your deposit back, unless you had a written contract stating you must complete paymant on a specified date.
