Mot exemption

So on 01/01/2021 my cabriolet was registered 40 years ago. So I taxed my vehicle and used V112 to declare MoT exemption under category r. 10 days later and its still showing as Mot expired in June 2021. The short version…. I ring DVLA and they tell me I do not qualify as there was no manufactured date supplied by the manufacturer at the time of registration. To this end they have calculated it to the end of the year which would be 31/12/1981.
They inform me that I should complain to the Post Office for them allowing me to tax my vehicle which they say they will cancel yet have still taken payment.
They kept trying to tell me that I don't qualify for tax exemption. I know that and have not claimed that but they keep deflecting me to that. They now want me to provide evidence of the manufacture date and that I should also fill in V112.
Somewhat peeved.

Mot exemption
Following this. My understanding was that you don’t get the tax exemption until the year following, so in effect your car is actually 41 years old when in your case you become exempt on jan 1st 2022 which is a bit of a swizz. I own an August ‘83 campaign, so also interested to know what happens when you get to the 40 year anniversary

Yes you have to wait until the following April to get the car registered as an historic vehicle with the DVLA, you need to send your log book away and get a new one back.
The post office can help with sending your log book away then the car will have free road tax (you still need to apply for free road tax each year) and you don't need a yearly MOT. I believe you can write to VW and get a build certificate with the date of manufacture on it but it will cost you. Not sure how you go about doing this?

So the reply was as follows. I have investigated the date of manufacture and boy was I surprised. So might you be if your vehicle was registered around 01/08/81. More on that another time. Have a read and polite comments please. I'm not claiming Tax exemption only MoT exemption. I will also post DVSAs comment later on.
I can only reiterate the previous responses, and highlight that due your vehicle does not qualify for Historic Tax until April 2022. As this vehicle is not recorded as being 40 years old yet, you would be unable to claim the MOT exemption. Any further queries regarding the MOT should be directed to DVSA, as they handle MOT systems, whereas DVLA deal with the tax side.
We currently have the date of manufacture for your vehicle as 31-12-1981. The reason for this is when the vehicle was initially registered, the DVLA was not supplied with enough evidence for the specific date the vehicle was manufactured. Due to this, we have only been able to provide the date of manufacture at the last day in that year.
To have this date investigated, you would need to supply the DVLA with additional evidence of the exact date of manufacture if you would like the vehicle record to be more specific.
Acceptable dating evidence can be obtained from:
- an extract from the manufacturer/factory record - these will have the chassis number of the vehicle against the month and year of production*
- an extract from the 'Glasses guide' - which is a comprehensive guide on production dates and includes chassis numbers.
- a dating letter that is accompanied by an extract from or references the "Trader Handbook"* An extract from the Trader handbook alone is not acceptable.
*A certified copy of the factory record (with the embedded stamp) will be acceptable only from the British Motor Industry Heritage Trust (BMIHT).
If you can obtain the qualifying evidence,
you will need to produce dating evidence and submit the application to DVLA, Swansea, SA99 1BF.
The following documentation will need to be submitted:
- V5C Registration Certificate
- V62 Application for a registration certificate if you are not in possession of the V5C* (You will need the VIN/Chassis Number to complete the application)
- V10 Tax Application form
- valid MOT Certificate (if applicable) or V112 'Exemption from MOT testing' form
- Dating evidence
*Please note that there is a £25 charge if a V62 is completed. This will need to be included by cheque or postal order.
You should write 'Historic' in the change to taxation class field in section (*) of the V5C.
Paper applications are likely to take between 6-10 weeks to process, however there may be additional delays in processing more complex transactions.
You can now check the earliest dates our departments are currently working and for any updates on our services here: DVLA services update - GOV.UK.

Mot exemption
But your car was registered on 01/01/81? Surely this is proof that the car was manufactured before that date, if it was physically on the road, so you should have been tax exempt from 01/04/21?
Must be worth another letter to the dvla with a scan of your V5C.
I wouldn’t worry quite so much about the MoT as it’ll be January before the paperwork gets done…

No it would need to be manufactured by 31/12/80 to be exempt in 2021. And if manufactured in any date 81 then it’s exempt in April 2022.

The point is that according to the information available is that a vehicle should be MOT exempt at the age of 40. This is not the case. How can my manufactured date be after the vehicle was built? I also asked if I would be MOT exempt on 01/01/2022 and the reply was no. DVLA have had a scan of my V5c.
The rolling 40 year exemption is not black and white.
TAX exemption is gained the year after so again not black and white.
A much simpler system would be that they are both TAX and MoT exempt at 40……
Please also see form V112 section r

My understanding is you only get mot exemption if the car is recorded as a historic vehicle, i cant see that you can have mot exemption without tax, as it seems the same thing is needed for both. So any car from 81 can requested historic from April 2021 provided it meets the criteria.
Thats how it reads to me, my S1 is historic and my 81 GLi will be next April if the scheme continues.

It is not the case wholly that you receive MOT exemption when it gains tax exemption as you can obtain MOT exemption first. So as of yesterday my car is now MOT exempt backdated to 01/08/21 but I will still have to pay my car tax until April next year when it is then TAX exempt as well. I did get a dating letter and found out my car was built in January 1981 which did surprise me and missed out on total exemption by 2 weeks. So if your car is registered round this time you may also be surprised. Another sign of the times is that although I had an email proof I photographed the letter when it arrived and all of the updating was done online.
Perhaps tax exemption statement should be read in the following manner,
"VED exemption is attained on April 1 following it's 40th anniversary"
Despite most readings saying that a car is MOT exempt at 40 it may have to be proven as set out in one of my other posts above from the DVLA reply.
